Terms of Use
General Terms and Conditions of Use for the YourLiebherrCareer Portal of the Liebherr Group of Companies
(hereinafter “Terms of Use”)
The subject matter of these Terms of Use is the YourLiebherrCareer online career portal (hereinafter “Portal”) of the Liebherr Group provided by Liebherr-IT Services GmbH (hereinafter “LIS” or “we”). The Portal enables a registered natural person who has an interest in employment with a company that is part of the Liebherr Group (hereinafter “you” or “User”) to set up and manage a candidate profile; to search for and obtain job postings of the Liebherr Group; to be included in the candidate pool of the Liebherr Group; to create and send applications to companies of the Liebherr Group; and to manage such applications.
1. Scope
The following Terms of Use apply exclusively to the use of the Portal by a registered User. The provider of the portal is Liebherr-IT Services GmbH, St. Vitus 1, 88457 Kirchdorf, Federal Republic of Germany, represented by its managing directors.
2. Requirements for Use
2.1 Setup of a User Account
2.1.1 To use the Portal, the User must set up a free user account (hereinafter “Account” or “Career Account”). If the User is already employed with a company of the Liebherr Group (“Liebherr Employee”) and has a personal Liebherr Employee account (Active Directory Account), he/she does not necessarily have to create a Career Account, but can log in to the Portal via his/her existing Liebherr Employee account and use the account in accordance with these Terms of Use.
To set up a career account, the user can call up a registration form on the portal. If the quick application function (see section 3.4) is available for a job advertisement, the user can click on a corresponding button in the respective job advertisement to go directly to a form that allows the user to register to set up an account and send an application at the same time. The User can set up an Account by completing the fields marked as mandatory (mandatory fields) on the registration form (email address, password, first name, last name, and country/region of the User’s place of residence). The data entered by the User during registration can be later changed at any time via the “My Core Data” section (see Section 3.1.1 “My Core Data”).
2.1.2 In setting up the Account, the User must also select the extent to which LIS is to make his/her candidate profile accessible to the companies of the Liebherr Group and whether, and if so, to what extent the User would like to upload and make his/her candidate profile visible in the candidate pool of the Liebherr Group in order to be considered for the staffing of any alternative job openings that match his/her candidate profile (“Visibility Setting”). In doing so, the User must select one of the Visibility Setting options listed in Sections 3.2.1 to 3.2.3, and the provisions under Section 3.2 apply. After registering, the User can change his/her selection (Sections 3.2.1 to 3.2.3) in the Portal via the “My Settings / Candidate Pool” section at any time with effect for the future (see Section 3.2).
2.1.3 During registration, the User can also select whether he/she would like to utilize the “Job Alert” function. The provisions in Section 3.7 apply to the Job Alert. The User can later change the selected Job Alert setting at any time via the “My Job Alerts” section (see Section 3.7).
2.1.4 The User shall ensure that the personal information that he/she provides for the Account during registration, particularly first and last names and email address, are true and correct. The User may not provide any data of third parties. The User shall notify LIS immediately of any change in the data or amend the data him/herself in his/her candidate profile.
2.1.5 The submission of the completed registration form by the User constitutes the User’s offer to enter into an agreement regarding the use of the Portal with the content of these Terms of Use (“User Agreement”). LIS shall accept this offer by confirming registration for the User via email, thereby creating the User Agreement.
2.1.6 After receipt of the registration form by LIS, the User will receive an email with a passcode that is valid for a few minutes to authenticate the email address provided by the User. The User shall confirm the authenticity of his/her email address and activate his/her account by entering this valid passcode in a second registration form to which he/she is automatically forwarded after submitting the first registration form in accordance with 2.1.5, and by submitting the second registration form.
2.2 Limitation, End, and Withdrawal of Rights of Access
In the event of violations of these Terms of Use, particularly due to
- the provision of false information during or after registration and/or
- the unauthorized forwarding or disclosure of login details, particularly the password,
LIS reserves the right to definitively strip the User of access to the Portal with immediate effect or with a notice period at the discretion of LIS, and/or terminate the User Agreement for cause and without notice in accordance with Section 5.2. After such a case, the User may not re-register without the prior express consent of LIS.
3. Portal offering
Among other functions, the Portal enables the registered and logged-in User to easily create and manage his/her candidate profile and applications. Essentially the following functions are available to the User free of charge.
3.1 The general candidate profile of the User consists of the information entered by the User in the “My Core Data” and “My Documents sections.
3.1.1 Via the “My Core Data” section, the User can enter or change his/her personal data. The User can also delete his/her personal data provided that it is not marked as mandatory data (mandatory fields).
3.1.2 Via the “My Documents” section, the User can save various documents (e.g., cover letters, resume, certificates). The User must save a resume in order to complete the candidate profile. Optionally, the User can add a cover letter and additional documents such as letters of reference.
3.2 Via the “My Settings / Candidate Pool” section, the User can change the selection made during registration at any time in accordance with Section 2.1.2 concerning the extent to which LIS makes his/her candidate profile available to the companies of the Liebherr Group and whether, and to what extent the User would like to upload and make his/her candidate profile visible in the candidate pool of the Liebherr Group. The User must select one of the following options, i.e., either
3.2.1 that LIS makes the User’s candidate profile available to all companies of the Liebherr Group worldwide,
or
3.2.2 that LIS makes the User’s candidate profile available to all companies of the Liebherr Group headquartered in the country that the User has indicated as his/her country of residence in his/her candidate profile,
or
3.2.3 that LIS makes the User’s candidate profile as well as additional information regarding a specific application (application data) only to those companies of the Liebherr Group for whose position(s) the User has applied, i.e., submitted an application via the Portal.
If the User selects option 3.2.3 above, the User will not be included in the candidate pool of the Liebherr Group.
If the User selects option 3.2.1 or 3.2.2 above, at the User’s instructions, LIS shall include the User’s candidate profile in the candidate pool of the Liebherr Group without any additional information regarding specific applications (application data) and make the User’s candidate profile accessible to the respective companies of the Liebherr Group according to the selection made by the User (“Visibility Setting”). If the User selects option 3.2.1 or 3.2.2 above, he/she at the same time grants his/her consent to the respective companies of the Liebherr Group to process the data of his/her candidate profile according to the selection made with respect to a specific application so that the User can be considered in a candidate search for the staffing of alternative job openings, where possible. The respective employees of the selected companies of the Liebherr Group responsible for the candidate search (“Recruiters”) can find the candidate profile in the candidate pool via search functions by means of different criteria, view the candidate profile, and contact the User by telephone, in writing, or electronically. In specific cases, the candidate profile is also made available to selected managers. This can also include managers of other companies of the Liebherr Group as part of functional management. Functional management refers to the company-wide combination of subject-specific and designated areas within the Liebherr Group under common management. It is therefore possible that you will be employed by one company of the Group, but your manager will be employed by a different company of the Liebherr Group.
3.3 Via the “My Settings / Candidate Pool” section, and after accessing the Terms of Use there, the User also has the option to terminate the User Agreement in accordance with Section 5.2 and thus close the Account.
3.4 The User can create applications for specific job postings as follows: By clicking on the appropriate button in the corresponding job posting, the User reaches the corresponding applicant screen. A specific application consists of the job-specific information that is requested in the respective job posting or applicant screen and entered by the User (“Application Data”), as well as the general candidate profile of the User. After entering the fields of the applicant screen that are marked as mandatory, the User can then submit the application. If the User does not yet want to submit a specific application, he/she can save it as a draft and, where applicable, complete and submit it later (see Section 3.6).
The quick application function can be provided for selected vacancies.
If this function is available for a job advertisement, the user can click on a corresponding button in the respective job advertisement to go directly to a form which simultaneously enables the user to register to set up an account (see section 2.1) and submit an application. If the user does not yet have an account, they can also apply to create an account in accordance with section 2.1.5 when sending the completed quick application. However, if the user already has an account, they can first log in to their account via a corresponding button in the quick application form. After logging in, the user is taken back to the quick application screen, in which the required information from the general candidate profile (see section 3.1) has now been automatically transferred and filled in, so that the user only has to fill in the job-specific application data.
Note: If other documents (resume, cover letter, certificates) are uploaded as part of a specific application, these documents will replace the previously saved documents, if any, in the “My Documents” section when submitting the application as well as for the general candidate profile so that the new documents will then become a part of the candidate profile as well. The replaced documents, if any, will then only be a part of any earlier, already submitted applications or applications saved as a draft.
Note: No company of the Liebherr Group intentionally collects specific types of personal data (information on political views, race, or ethnic origin; religious or philosophical beliefs; union membership; health; or sex life) from the User if and insofar as such collection is not required by applicable national law and/or permitted by applicable national law on the favoring certain groups. The User is therefore asked not to provide any information regarding the aforementioned criteria as part of his/her application unless he/she is requested to do so in a mandatory field.
As soon as the User submits the application, we will transmit on behalf of the User the specific application (candidate profile and application data) to the respective company of the Liebherr Group indicated in the job posting. If the user uses the quick application function and does not yet have an account, the creation of an account is requested at the same time as the application is sent (see 2.1 above).
3.5 Via the “My Applications” section, the User can obtain an overview of his/her submitted applications as well as access, change, and withdraw his/her applications as long as no commitment or rejection has been made by a company of the Liebherr Group in connection with the application.
3.6 The User can access, edit, change, submit, or delete applications that have been saved as drafts and that have not yet been submitted using the “My Drafts” section. Such drafts are not made available to the companies of the Liebherr Group.
3.7 The User of the Portal can set up a “Job Alert” and have it sent via email. A Job Alert is the regular sending of information regarding current job postings of companies of the Liebherr Group that match the User’s selected search criteria. To set up a specific Job Alert, the User must first grant his/her consent to receive a Job Alert. The User can do this either when registering his/her Account (see Section 2.1.3) or later via the Options section under “My Job Alerts”. The User must then select his/her search criteria via the “Create Job Alert” section and accordingly create a specific Job Alert. By clicking on the corresponding button, the respective Job Alert is created and, in doing so, the User consents to be regularly informed by us via email regarding job postings that match the search criteria that he/she has specified. Via the My Job Alerts section, the User can change the specific Job Alerts at any time and revoke the corresponding consents with effect for the future.
3.8 Via the “Options” section, under Settings, the User can change his/her password and terminate the User Agreement in accordance with Section 5.2 and thus close the Account.
3.9 LIS merely provides the Portal. The respective company of the Liebherr Group that posts a job is responsible for the specific job posting.
3.10 LIS does not assume any responsibility for the completeness and accuracy of the information provided with regard to job postings of other companies of the Liebherr Group.
4. Duties of the User
4.1 Login details for an Account are intended exclusively for use by the respective User. The User may not pass on the login credentials, especially his/her password, to unauthorized third parties. The User shall keep login credentials, especially the password, confidential at all times.
4.2 If the User learns of misuse of his/her login credentials, or if he/she suspects such misuse, he/she shall inform LIS of this immediately. In the event of misuse or suspected misuse, LIS may immediately block the affected Account and/or terminate the account without notice in accordance with Section 5.2.2. The User is liable for all consequences of third-party use unless the User is not responsible for the misuse of the login credentials. The User must assume responsibility for the misuse particularly even if he/she at least negligently enabled the unauthorized use of the login credentials. However, the User must assume responsibility for the consequences of the misuse only up to the time he/she notified LIS customer service of the misuse via email (MySuccess.DataPrivacy@liebherr.com) and, if necessary and possible, changed the password.
4.3 The User shall not save any content on the Portal whose provision, publication, or use violates applicable law, third-party rights, or the principles of youth protection. The User is prohibited from doing the following in particular:
- uploading, disseminating, offering, or promoting content, services, or products that are pornographic or fraudulent in nature or that violate youth protection laws, data privacy laws, or any other law;
- uploading content that insults or defames other Users or third parties;
- uploading political content;
- uploading content, services, or products that are legally protected or encumbered by third-party rights (e.g., copyrights), without being expressly authorized to do so.
The User is also prohibited from engaging in the following activities when uploading his/her own content to the Portal, regardless of any violation of the law:
- spreading viruses, trojans, or other harmful files;
- spreading offensive, sexual, obscene, or defamatory content or communications as well as such content or communications that are likely to promote or support (explicitly or implicitly) racism, bigotry, hate, physical violence, or unlawful actions.
Any action that is likely to compromise the smooth operation of the Portal or overload the IT systems of LIS is prohibited.
4.4 If LIS learns that the content uploaded by a User violates these Terms of Use or if there are specific indications that such a violation will arise, LIS, taking into account the legitimate interests of the User, reserves the right to refuse the uploading of content and/or to block or remove (without prior notice) content that has already been uploaded.
4.5 The User grants LIS the simple, nonexclusive right, free of charge and unlimited with respect to time and location and limited to the term of the User relationship, to use, duplicate, edit, transmit, export, and display the data and documents that the User saves in the Portal, provided that this is necessary to provide the services owed in accordance with these Terms of Use. LIS is also authorized to keep the data available in a backup data processing center. LIS is authorized to engage the services of third parties at any time.
5. End of the User Agreement
5.1 The User Agreement ends, without the need for any notice to be given, after one year from the time the User last logs in to the Account, unless one or more specific applications are still active. An application is active if it has been submitted and has not been withdrawn by the User and no commitment or rejection has been made by a company of the Liebherr Group in connection with the application. We will notify the User of this via email before the end of the aforementioned period.
5.2 Termination of the User Agreement
5.2.1 Both the User and LIS may terminate the User Agreement for convenience at any time without observing a notice period.
5.2.2 Both parties reserve the right to terminate the User Agreement for a compelling reason. A compelling reason exists for LIS in accordance with Sections 2.2 and 4.2.
5.2.3 Notice of termination must be given in text form, i.e., at least via email. In the Portal, the User also has the option to terminate the User Agreement at any time without observing a notice period either via the Options section under “Settings” or via the My Settings / Candidate Pool” section after accessing the Terms of Use. The User will have to click on the corresponding button and reconfirm in each case.
5.3 When the User Agreement ends, the User will no longer be able to log in to the Portal. Data saved in the Portal will no longer be available to the User and will be permanently deleted by LIS. In addition, all of the User’s applications sent via the Portal will be withdrawn provided that no rejection or commitment has been issued by a company of the Liebherr Group regarding the applications.
6. Liability
6.1 Claims for damages by the User are excluded unless provided for otherwise in the data privacy notices and the Terms of Use. This limitation of liability also applies for the benefit of legal representatives and vicarious agents of LIS in the event that the User asserts claims against them.
6.2 Claims for damages that result from an intentional or grossly negligent breach of duty by LIS, a legal representative, or a vicarious agent are excluded from this limitation of liability. Only slightly negligent breaches of material contractual duties are also excluded from this limitation of liability.
6.3 Liability mandated by law, particularly liability in accordance with the Product Liability Act and liability in the event of culpable injury to life, limb, or health of a User, remains unaffected by the aforementioned limitation of liability.
7. Availability
7.1 There is no entitlement to uninterrupted use of the Portal. It is not guaranteed that service work, further developments, or other disturbances, which could also lead to data losses, will not interfere with access or use of the Portal. LIS shall endeavor to ensure as uninterrupted usability of the Portal as possible. However, temporary limitations or interruptions can occur as a result of technical failures (power outages, hardware and software bugs, technical problems in the data lines).
7.2 We reserve the right to change or temporarily or permanently discontinue individual functions of the Portal or the Portal in its entirety at any time without indicating the reasons for doing so.
8. Data Privacy
The protection and security of Users’ personal data is very important to LIS. All information about this can be found here.
9. Copyrights, Trademark Rights, and Other Intellectual Property
The content provided by LIS via the Portal (text, data, images, logos, graphics, documentation, audio, video, and other pictorial representations) are subject to copyright and other laws on the protection of intellectual property. Without the prior express consent of the respective rights holder, the content may not be reproduced, disseminated, saved in other media (e.g., other websites), or modified in whole or in part.
10. Amendments to the Terms of Use
LIS reserves the right to amend these Terms of Use at any time without indicating the reasons for doing so. If the user acknowledges an amendment during his/her login following the amendment, a new User Agreement will be formed with the content of the amended Terms of Use. Without acknowledging the new Terms of Use, further use of the Portal will not be possible and the User will lose access to the Portal and the data entered and retrievable therein. The User’s data will continue to be processed until the amended Terms of Use are acknowledged and based on the Terms of Use applicable up to that point.
11. Final Provisions
11.1 The mandatory provisions of the law of the country in which the User has his/her usual place of residence apply to this User Agreement, the Terms of Use, and their interpretation. Apart from this, the law of the Federal Republic of Germany applies, to the exclusion of conflict-of-law provisions.
11.2 If individual provisions of these Terms of Use prove to be or become ineffective and/or unenforceable, the validity of the remaining provisions will remain unaffected.
